POSITION PURPOSE

Assists Litigation Specialist, General Counsel and staff with daily activities, which includes maintaining legal files/systems for Litigation Specialist, preparing accounts for legal proceedings, reporting, billing, responding to subpoenas, creating copies, organizing documents, representing ERC in court as necessary, and any special projects or assignments. Responsible for the coordination of all details related to the judicial enforcement of toll violations before, during and after court proceedings. This includes assisting during all phases of the litigation process including preparing documents, attending court proceedings, and negotiating settlements with customers before, during, and after litigation proceedings.

Essential Functions And Basic Duties

  • Assumes responsibility for the effective performance of all assigned clerical and support functions.
  • Assist with keeping cases organized by establishing and organizing files; monitoring calendars; meeting deadlines; documenting actions; inputting information into file database and/or court portal; confirming case status with attorney and/or court clerks as necessary.
  • Creates photocopies and reproductions of summons records and other legal documentation
  • Inserts correct documents into envelopes, creates mailing labels, and utilizes appropriate postage
  • Responds to internal and external court status inquiries using various communication channels
  • Receives and replies to defendant inquiries regarding court status via phone
  • Uses appropriate sources, methods, and equipment to perform legal research and gather information.
  • Follows laws and procedures in accessing public and private records.
  • Conducts pre-claim investigations, legal research, and initial case assessments to ensure eligibility for litigation.
  • Creates batches of qualified accounts for summons filing
  • Utilizes back-office software to research,understand, and document customer accounts.
  • Enhances trial proceedings by organizing evidence; preparing exhibits; taking courtroom notes.
  • Maintains confidentiality of documents and case information.
  • In times where Litigation Specialist is unavailable, act as a backup for all related tasks for court proceedings. by supporting ERC outside counsel.
  • Assumes responsibility for establishing and maintaining effective communication and coordination with area staff and management.
  • Maintains detailed notes on accounts, communicating case progress and consistently updating changes.
  • Ensures documents are legal, accurate, in proper format, and use appropriate terminology.
  • Ensures correspondence and reports are accurate, factual, and timely.
  • Assist as necessary in preparing document packages required for judicial proceedings.
  • Keeps management informed of area activities and of any significant problems.
  • Assumes responsibility for related duties as required or assigned.
  • Assists with special projects as assigned.
  • Ensures work area is clean, secure, and well maintained.

  • Court procedures and protocols are followed, behavior is appropriate, and the company’s professional image is upheld.

Qualifications

Education/Experience

 High school diploma or GED.

 Three years related experience and/or training; or equivalent of education and experience in office/clerical duties.

Preferred Knowledge

 Knowledge of litigation/legal terminology.

 Knowledge and experience with filing systems.

 Knowledge of methods and procedures for handling and accounting for money.

 Knowledge of company policies and procedures.

Preferred Skills/Abilities

 Strong administrative skills, including the ability to independently organize, prioritize and manage multiple tasks.

 Good analytical skills and attention to detail.

 Ability to discreetly handle highly confidential information.

 Strong knowledge of PC-based applications, specifically Word, Excel and Power Point is required.

 Ability to learn new programs is essential.

 Ability to communicate clearly, concisely, and accurately both verbally and in writing.

 Strong interpersonal skills, including the ability to effectively interface with the customers, outside counsel, different departments, outside law firms, and in the field, and maintain relationships with each.

 Ability to follow detailed, established procedures.

 Ability to operate related computer applications and other business equipment including calculator, copy machine, printer, telephone, fax.

 Willingness to stay late occasionally, sometimes on short notice, and otherwise be flexible about work hours, if necessary, to accommodate workflow and business needs.

PHYSICAL STRENGTH: Sedentary work; sitting most of the time. Exerts up to 10 lbs. of force occasionally. (Almost all office jobs.)

Mental Activities And Requirements Of This Position

REASONING ABILITY: Ability to apply common sense understanding to carry out instructions with multiple steps and to deal with ordinary, standardized situations.

MATHEMATICS ABILITY:Ability to perform very basic math skills including adding, subtracting, multiplying, and dividing two-digit numbers; the four basic arithmetic operations with money. Ability to perform very simple algebra, ratios, proportions, and percentages.

LANGUAGE ABILITY: Ability to use passive vocabulary of 5,000-6,000 words, read at a slow rate, and define unfamiliar words in dictionaries for meaning, spelling, and pronunciation. Ability to write complex sentences, using proper punctuation, and using adjectives and adverbs. Ability to communicate in complex sentences, using normal word order with present and past tenses and good vocabulary. Ability to prepare reports and summaries using prescribed format and confirming to all rules of punctuation, grammar, diction, and style. Ability to read manuals, dictionaries, thesauruses, and encyclopedias. Ability to communicate during discussions and to make professional presentations.
